This Acceptable Use Policy ("AUP") describes your responsibilities when you use the theKrew.ai platform and services (the "Services"). It is incorporated into our Terms of Use by reference. Violations may result in suspension or termination of your account.
1. Your Responsibilities
theKrew.ai sends emails, publishes content, and runs campaigns on your behalf. Because content is sent under your name, your domain, and to your prospect lists, you retain full editorial control and full responsibility for what goes out:
- You retain full editorial control: every cold email template, sequence, and landing page is reviewable and approvable by you before it goes live, and you have the ability to pause, edit, or stop any campaign at any time.
- You are responsible for the accuracy, lawfulness, and consequences of all content sent through the Services under your name or your domain.
- You warrant that you have a legitimate business interest in contacting every recipient on your prospect lists (a "good-faith basis" under the U.S. CAN-SPAM Act) and have the legal right to contact them in their jurisdiction.
- You are responsible for honoring unsubscribe requests promptly and complying with all applicable email-marketing laws, including CAN-SPAM (United States), CASL (Canada), GDPR and the ePrivacy Directive (EU/UK), and any other applicable law in your target geographies.
- You are responsible for the quality and provenance of your prospect lists. You may not upload purchased lists, scraped lists from non-public sources, lists obtained from competitors or former employers in violation of NDAs or trade-secret laws, or lists obtained in a manner that violates the data-protection laws of the recipients' jurisdiction.
- You acknowledge that AI-generated content (cold-email drafts, landing-page copy, social posts, ad copy) is provided for your review, and that approving and sending such content makes you fully responsible for it. AI may produce inaccuracies, hallucinations, or content that requires correction.
2. Prohibited Activities
You may not use the Services to send, host, store, or distribute:
- Spam, unsolicited bulk messages, or any communication that violates anti-spam law.
- Phishing attempts, malware, viruses, ransomware, or any malicious code.
- Content that infringes any intellectual-property right, including copyrighted text, images, logos, or trademarks you do not have permission to use.
- Content that promotes illegal activity, fraud, deception, or any practice that constitutes an unfair or deceptive trade practice under the FTC Act or analogous state law.
- Hate speech; harassment; threats of violence; sexually explicit content; content that exploits minors; content that promotes self-harm.
- Content related to gambling, where prohibited by the recipient's jurisdiction.
- Content related to firearms, controlled substances, prescription medications, sexual services, or any business or product category restricted by the Stripe Restricted Businesses List (because we use Stripe to process payments and certain categories cannot be supported).
- Impersonation of any person, business, or government entity.
- Content that violates the advertising or content policies of any third-party platform we integrate with (Meta, Google Ads, LinkedIn, X, TikTok, Instagram, etc.) when running campaigns through those platforms on your behalf.
- Activity that interferes with the integrity, security, or normal operation of the Services, including attempts to scrape, reverse-engineer, or extract source code.
3. Our Role & Responsibilities
- We provide the platform, AI agents, sending infrastructure, and integrations.
- We do not pre-review individual campaigns, emails, posts, or ads for legal compliance — that responsibility belongs to you.
- We may suspend or terminate accounts that violate this AUP, including without prior notice in cases of clear or severe violations.
- We may report suspected illegal activity to law enforcement and respond to lawful subpoenas, court orders, and other legal process.
4. Liability Disclaimers
theKrew.ai is not responsible for, and disclaims liability for:
- Content that you create, upload, approve, or send through the Services, regardless of whether the content was first drafted by an AI agent.
- Compliance failures arising from your prospect lists, your industry classification, or the geography of your recipients (including any failure to obtain consent where the recipient's jurisdiction requires it).
- Recipient complaints, bounces, unsubscribes, or spam reports for campaigns you run.
- Email-deliverability issues caused by your domain reputation, content choices, sending volume, warmup status, or third-party blocklist actions.
- Actions taken against you by Meta, Google, LinkedIn, Stripe, Instantly, or any other third-party platform whose terms of service you violate (including ad-account suspensions or payment disputes).
- The accuracy, completeness, currency, or fitness for purpose of any AI-generated content, market research, ICP analysis, or competitor intelligence.
- Lost revenue, customer loss, reputational damage, or any other indirect or consequential harm arising from your use of the Services.
5. Indemnification
You agree to indemnify, defend, and hold harmless theKrew.ai and Tuple Technologies, and our respective officers, directors, employees, contractors, and agents, from and against any third-party claim, demand, regulatory action, fine, settlement, or expense (including reasonable attorneys' fees) arising from or related to: (a) content you send, post, or publish through the Services; (b) your prospect lists, targeting choices, or compliance failures; (c) your violation of this AUP, the Terms of Use, or any applicable law; or (d) compromise of your account credentials due to your negligence.
6. Reporting Violations
If you believe an account is violating this AUP — for example, you received unsolicited spam from a theKrew-powered campaign — email us at hello@thekrew.ai with the subject line "AUP Report" and a description of the suspected violation, including any headers or message content that helps us identify the source.
We aim to respond to AUP reports within five (5) business days. We may, in our sole discretion, suspend the offending account during investigation.
7. Changes to This Policy
We may update this AUP from time to time. When we make material changes, we will update the "Effective date" at the top of this page and notify active subscribers by email and an in-dashboard banner at least 14 days before the new version takes effect.
