Terms of Use

These Terms of Use ("Terms") form a binding agreement between you and Tuple Technologies ("theKrew," "we," "us," or "our") governing your access to and use of the theKrew.ai website, platform, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & Account

• You must be at least 18 years old and have the legal capacity to enter a binding agreement.
• At launch, the Services are offered to customers in the United States, Canada, the European Union, and the United Kingdom. We may expand availability over time.
• One account per business. Account access is non-transferable; you may not resell, sublicense, or share access to your account.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@thekrew.ai if you suspect unauthorized access.
• If you sign up on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Subscription & Trial Terms

Free trial. New accounts receive a 15-day free trial with no charge at signup and no credit card required. After day 15, the trial expires automatically and the Services pause for your account. We do not auto-charge you at the end of the trial — to continue, you must opt in by adding a payment method and selecting a plan.

Plans. Current paid plans are Starter ($99/month), Growth ($249/month), and Scale ($499/month), billed in USD or CAD where applicable. Pricing for each plan and the features it includes are described on our pricing page.

Auto-renewal. Paid subscriptions auto-renew on a monthly cycle until you cancel. Each renewal charge is billed to the payment method on file at the start of the billing period.

Cancellation. You may cancel at any time from Settings → Billing in your dashboard. Cancellation takes effect at the end of the current billing cycle. We do not refund partial months. Where applicable state law (for example, California SB-313) requires a different cancellation right, that law controls.

Upgrades and downgrades. Plan upgrades take effect immediately and are prorated against the remainder of the current billing cycle. Plan downgrades take effect at the start of the next billing cycle.

Add-ons and top-ups. Optional one-time purchases such as additional AI Actions are billed as one-time charges and are non-refundable.

Pricing changes. We may change subscription pricing with at least 30 days' advance notice to existing subscribers, delivered by email and an in-dashboard banner. The new price applies on the next billing cycle that begins after the notice period ends. If you do not agree to the new pricing, you may cancel before it takes effect.

3. Service Description

The Services include:

• AI agents that perform research, copywriting, campaign management, design, analytics, and SEO tasks on your behalf.
• Cold-email campaigns sent through Instantly.ai sending infrastructure under domains and accounts you authorize.
• Landing pages hosted on theKrew.ai infrastructure.
• Daily activity summaries delivered by email.
• Optional paid-advertising management within ad accounts you own (Meta, Google, etc.) via OAuth-delegated access; ad spend is billed by the advertising platform directly to you and is separate from your subscription.

We may add, modify, or remove features over time. We will not materially reduce the functionality of a paid plan during your current billing cycle without notice.

4. Intellectual Property & License

Your content. You own the content your account generates and approves through the Services, including emails, posts, articles, ads, and landing pages.

Our platform. We own the theKrew.ai brand, software, AI orchestration system, prompts, and underlying technology.

License you grant us. You grant us a limited, revocable, non-exclusive, royalty-free license to process your data, content, and inputs solely to deliver the Services to you.

License we grant you. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services during the term of your active subscription.

5. Acceptable Use

Your use of the Services is subject to our Acceptable Use Policy, which describes prohibited activities, your responsibilities for content sent through the Services, deliverability, and anti-spam compliance. The Acceptable Use Policy is incorporated into these Terms by reference; violations may result in suspension or termination.

6. Termination

• You may cancel your subscription at any time, as described in Section 2.
• We may suspend or terminate your account for violation of these Terms or the Acceptable Use Policy, suspected fraud, payment chargebacks, or non-payment that exceeds 60 days.
• On termination, active campaigns are paused immediately and access to the platform ends.
• We retain your account data for 30 days after termination in case you reactivate. After 30 days, data is permanently deleted, except where retention is required by law (see Privacy Policy).

7. Disputes & Governing Law

Governing law. These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.

Forum. Any dispute arising from these Terms or the Services that is not resolved through informal negotiation or, where applicable, arbitration, shall be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to the personal jurisdiction of those courts.

Informal resolution. Before filing a formal claim, you agree to contact us at hello@thekrew.ai with a written description of the dispute and to attempt good-faith negotiation for at least 30 days.

Class action waiver. To the extent permitted by applicable law, you and we agree that any dispute will be resolved on an individual basis. You waive any right to bring claims as a class, collective, or representative action. If a court determines this waiver is unenforceable, the remainder of this Section will continue in effect.

8. Changes to These Terms

• We may update these Terms from time to time. When we do, we update the "Effective date" at the top of this page and notify you by email and an in-dashboard banner at least 14 days before the new version takes effect.
• For material changes (for example, pricing, data use, or dispute resolution), continued use after the effective date does not constitute acceptance — we will require explicit re-acknowledgement through the in-app banner.
• For non-material changes, continued use after the effective date constitutes acceptance.

9. Liability & Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee specific business outcomes such as a number of leads, conversions, replies, deliverability rates, or revenue.

To the maximum extent permitted by law, our total cumulative liability arising from these Terms or the Services is capped at the greater of (a) US $100 or (b) the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities.

Content-related liability disclaimers and your indemnification obligations are described in detail in the Acceptable Use Policy and are incorporated into these Terms.
